JM PRECISION HOME SERVICES

These Terms & Conditions ("Terms") apply to estimates, proposals, work orders, service requests, projects, and services provided by JM Precision Home Services ("JM Precision," "we," "us," or "our") unless a written agreement for a specific project states otherwise.

By approving an estimate, proposal, work order, change order, or service request, paying a required deposit, scheduling authorized work, or otherwise authorizing JM Precision to begin work, the customer ("Customer" or "you") agrees to these Terms and any project-specific terms incorporated into the applicable QuoteIQ document.

1. SCOPE OF SERVICES

JM Precision Home Services provides residential and commercial handyman, repair, maintenance, and improvement services.

Services may include:

General handyman repairs
Deck repairs and improvements
Deck boards, stairs, railings, and related carpentry
Carpentry and wood repairs
Wood-rot repair
Door repair and replacement
Drywall repair and patching
Interior and exterior painting
Fence and gate repair
Trim and molding
Minor fixture and hardware installation
Rental property repairs
Punch-list work
Property maintenance
Commercial property maintenance
Other repair and improvement services specifically stated in an approved project scope

The specific scope, price, materials, allowances, exclusions, payment schedule, options, and project-specific requirements will be stated in the applicable QuoteIQ estimate, proposal, work order, invoice, approved change order, or other written project document.

Work not specifically included in the written scope is excluded unless later added through an approved change order.

2. CONTRACT DOCUMENTS / ORDER OF PRECEDENCE

The agreement between JM Precision and the Customer may include:

The approved QuoteIQ estimate or proposal
The project-specific scope of work
These Terms & Conditions
Approved change orders
Written specifications, drawings, selections, or allowances
Payment schedules
Other documents expressly incorporated into the project

If a project-specific provision conflicts with these general Terms, the project-specific provision controls for that project, subject to applicable law.

3. QUOTE VALIDITY & PRICING

Quotes and estimates are valid for 15 days from issuance unless another period is specifically stated. JM Precision may revise pricing after that period because of changes in materials, supplier pricing, equipment or rental costs, subcontractor pricing, delivery, disposal, fuel, or other project costs.

Pricing is based on visible and reasonably discoverable conditions at the time of the estimate and information supplied by the Customer. Material quantities and measurements are reasonable estimates unless specifically stated otherwise.

Additional material, labor, equipment, or other costs caused by hidden conditions, inaccurate information, changed conditions, or customer-requested changes require an approved change order.

4. SCOPE CHANGES & CHANGE ORDERS

The approved written scope represents the work included in the quoted price. Additional repairs, concealed damage, structural discoveries, wood rot, water damage, prior improper workmanship, code-related conditions, customer-requested changes, or other additional work discovered after work begins are not automatically included.

Additional work requires a written or electronic change order and may affect:

Price
Labor
Materials
Schedule
Completion date

Change orders may be approved through QuoteIQ, electronic signature, email, text, or another written or electronic method that clearly documents Customer approval.

If an unforeseen condition creates an immediate safety concern or a risk of significant property damage, JM Precision may temporarily stop work or take reasonable temporary protective measures and will contact the Customer as soon as practical.

5. ELECTRONIC ACCEPTANCE

Approval of a QuoteIQ estimate, proposal, work order, service request, change order, or other electronic authorization may create a binding agreement for the stated work.

Electronic signatures, typed names, digital signatures, checked consent boxes, estimate approvals, and other legally recognized electronic acceptance methods may carry the same effect as handwritten signatures to the extent permitted by law.

6. DEPOSITS & PAYMENT TERMS

Deposits, progress payments, draws, and payment due dates are as stated in the approved project document. A deposit may be required to secure the project on the production schedule and may be used to order materials, reserve equipment, arrange deliveries, secure subcontractors, or otherwise prepare for the work.

Projects may include progress payments or draws based on milestones. Payment schedules shown in the approved QuoteIQ proposal or estimate are incorporated into the project agreement. For projects with specific milestone schedules, the QuoteIQ project payment schedule controls.

Final payment is due upon substantial completion unless the project document states otherwise. Minor punch-list items do not automatically delay payment of otherwise undisputed amounts. JM Precision may suspend or postpone work for nonpayment.

The Customer remains responsible for undisputed amounts due for authorized work and approved change-order work. If a project is canceled, amounts paid may be applied to actual and reasonable incurred or committed costs as permitted under Section 16 and applicable law. Any remaining unearned balance will be handled in accordance with the agreement and applicable law.

7. LATE PAYMENTS

Payments not received within 7 days of the stated due date may be subject to a late charge of 1.5% per month on the unpaid balance, or the maximum amount legally permitted if lower.

JM Precision reserves any payment, collection, and lien rights available under applicable law. Reasonable legally recoverable collection costs, court costs, and related expenses may be sought where allowed.

8. HIDDEN / CONCEALED CONDITIONS

Repair and maintenance work may reveal conditions that were not visible or reasonably discoverable during the estimate, including:

Hidden rot
Water damage
Termite or pest damage
Failed framing
Improper prior repairs
Concealed electrical, plumbing, or HVAC conditions
Mold or suspect materials
Structural problems
Hidden fasteners or attachments
Substrate failure
Conditions concealed behind walls, trim, siding, decking, flooring, doors, or other finished surfaces
Conditions that differ materially from information supplied by the Customer

JM Precision is not required to absorb additional work caused by these conditions into the original quoted price unless the original scope expressly includes that risk.

Work may stop until an appropriate change order or revised scope is approved. JM Precision will explain material concealed conditions affecting the work to the Customer before continuing the affected work.

9. SITE ACCESS & CUSTOMER RESPONSIBILITIES

The Customer must provide safe, reasonable, unobstructed access to the work area for workers, materials, tools, and deliveries. Customer responsibilities include:

Providing authorized use of electricity and water where reasonably needed
Moving or securing personal property in the work area
Securing pets
Keeping children, tenants, guests, and unauthorized individuals away from active work zones
Providing necessary gate or access information
Disclosing known hazards
Informing JM Precision of relevant property restrictions and access limitations
Obtaining HOA, landlord, property-management, or similar private approvals unless specifically included in JM Precision's scope

The Customer is responsible for identifying correct property boundaries, easements, restrictions, and areas where work is authorized unless surveying or boundary verification is specifically included in the scope. JM Precision may rely on measurements, plans, surveys, and other project information supplied by the Customer or the Customer's representatives.

Additional labor or trips caused by inaccessible or uncleared work areas may result in additional charges when appropriate. Costs or delays caused by materially inaccurate Customer information may require a change order, except where JM Precision knew or reasonably should have known the information was incorrect.

10. DIGGING / POST HOLES / UNDERGROUND UTILITIES

Incidental digging may be needed for deck footings, fence posts, or exterior repair work included in an approved scope. When underground work requires utility locating, applicable Tennessee 811 requirements must be followed. JM Precision will comply with applicable locate requirements for required digging performed by JM Precision.

When required, work may be delayed until the Tennessee 811 locate request is valid and participating utility operators have had the legally required opportunity to mark their facilities.

Tennessee 811 and participating utility locates generally do not identify private facilities. The Customer is responsible for identifying and disclosing private or unmarked facilities, including when applicable:

Septic components
Private water lines
Irrigation systems
Private electrical lines
Low-voltage systems
Invisible pet fences
Landscape lighting
Private drainage piping
Privately installed underground systems

JM Precision is not responsible for damage to concealed or unmarked private facilities that were not reasonably discoverable or disclosed, except to the extent caused by JM Precision's negligence or as otherwise required by law.

If an unknown or conflicting utility is discovered, work may stop until the condition can be safely evaluated.

11. CUSTOMER-SUPPLIED MATERIALS

If JM Precision agrees to install Customer-supplied materials, those materials must be correct, complete, compatible, undamaged, and available when needed. The Customer is responsible for their suitability, quantity, quality, and manufacturer warranty unless otherwise stated in writing.

JM Precision is not responsible for manufacturer defects, product warranties, missing parts, incorrect products, or compatibility problems in Customer-supplied materials.

Additional labor, delays, return trips, modifications, or replacement work caused by Customer-supplied materials may result in additional charges through a change order. JM Precision's workmanship warranty does not become a product warranty for Customer-supplied materials.

12. MATERIALS

JM Precision may use commercially reasonable materials that meet the project scope. Natural materials such as lumber and wood may vary in color, grain, moisture, dimensions, checking, knots, or appearance. Coatings, trim, and similar products may also have normal variations in texture or appearance.

Material substitutions may be proposed if specified materials become unavailable, delayed, discontinued, or impractical. Substitutions that materially change appearance, performance, scope, or price should be discussed with the Customer before installation when practical.

13. PERMITS / REGULATED WORK

Permits, inspections, engineering, architectural or design services, code-required upgrades, and regulated trade work are not included unless expressly listed in the written scope.

Permit and inspection responsibilities will be handled as stated in the project scope and in accordance with applicable law. JM Precision will only perform or subcontract regulated work as legally permitted.

14. SCHEDULING & DELAYS

Start dates and completion dates are estimates unless expressly guaranteed in writing. Potential delays may include:

Weather
Material or supplier delays
Delivery delays
Customer-requested changes
Concealed conditions
Inspection or permit delays
Site-access issues
Unsafe conditions
Subcontractor availability
Equipment issues
Circumstances outside JM Precision's reasonable control

JM Precision will make reasonable efforts to communicate material schedule changes. Weather-sensitive painting, staining, deck, fence, and exterior repair work may be postponed when conditions could create unsafe work or unacceptable quality.

15. CUSTOMER-CAUSED DELAYS

If the Customer delays work after labor, materials, deliveries, subcontractors, or equipment have been scheduled or committed, JM Precision may reschedule the project based on availability.

Actual additional costs caused by Customer delay may be charged through an approved change order or invoice as appropriate. These may include additional delivery, storage, return trips, equipment cancellation or extension charges, and subcontractor costs.

16. CANCELLATION

Either party may request cancellation in writing, subject to applicable law and project-specific terms.

If the Customer cancels after materials have been ordered or purchased, the Customer may be responsible, where legally enforceable, for:

Labor already performed
Special-order or nonreturnable materials
Committed project costs
Delivery charges
Equipment reservations or cancellation charges
Subcontractor commitments
Reasonable restocking charges

Where applicable, standard returnable materials may be subject to a 20% restocking charge. A 20% restocking charge will not be applied where the supplier's actual circumstances or applicable law do not support it. Nonreturnable or special-order material costs remain the Customer's responsibility when legally enforceable.

Certain transactions entered into at a Customer's residence or away from JM Precision's established place of business may be subject to statutory cancellation rights. When a transaction is subject to a statutory right of cancellation, the legally required cancellation period, notices, forms, and refund requirements control.

Applicable Tennessee and other statutory cancellation rights cannot be waived by these Terms. Nothing in these Terms is intended to waive or limit a Customer's non-waivable cancellation rights. Any remaining unearned balance will be handled in accordance with the agreement and applicable law.

17. SUSPENSION / TERMINATION

JM Precision may suspend or terminate work when reasonably necessary because of:

Nonpayment
Unsafe conditions
Illegal or prohibited work
Undisclosed hazards
Inability to obtain access
Harassment, threats, or abusive conduct toward workers or subcontractors
Customer interference with safe performance
Discovery of specialized or licensed work outside the contracted scope
Material breach of the project agreement

When practical, JM Precision will provide notice and an opportunity to correct the issue before termination. The Customer remains responsible for properly due amounts for authorized work and reasonable incurred or committed project costs through suspension or termination, subject to applicable law.

18. CLEANUP

JM Precision performs normal jobsite cleanup appropriate to the contracted scope. Removal or disposal of demolition debris or other materials is included only when specifically stated or reasonably inherent in the included work.

Unexpected disposal needs or special handling may require additional charges through a change order.

19. HAZARDOUS / SUSPECT MATERIALS

JM Precision does not provide specialized asbestos abatement, hazardous-material remediation, contaminated-material remediation, or similar environmental work unless specifically contracted and legally permitted.

If suspect materials are encountered, work may stop until evaluated by an appropriate qualified party. Specialized testing, removal, disposal, or remediation will be handled separately by properly qualified parties when required.

20. 365-DAY LIMITED WORKMANSHIP WARRANTY

JM Precision Home Services provides a 365-day Limited Workmanship Warranty on labor performed directly by JM Precision, beginning on the date of substantial completion, unless a different written warranty is stated in the project documents.

Covered: Defects caused by JM Precision's workmanship.

Not covered:

Normal wear and tear
Routine maintenance
Customer-supplied materials or products
Manufacturer defects
Material failure outside JM Precision workmanship
Natural wood checking, splitting, movement, shrinkage, expansion, or weathering
Misuse, abuse, or neglect
Damage by animals, occupants, contractors, or third parties
Pre-existing conditions
Hidden or concealed defects outside the approved scope
Severe weather, storm damage, flooding, or Acts of God
Work modified, repaired, or altered by others
Failure to perform required maintenance

Manufacturer warranties, when available, remain subject to the manufacturer's own terms. The Customer must give JM Precision reasonable notice and an opportunity to inspect a claimed workmanship defect and, when covered, correct the issue.

Except for emergencies requiring immediate action to prevent further damage or protect safety, the Customer should allow JM Precision a reasonable opportunity to inspect before another contractor alters the affected work.

21. SUBSTANTIAL COMPLETION / PUNCH LIST

A project is substantially complete when the contracted work is sufficiently complete for its intended use, even if minor punch-list or cleanup items remain.

When practical, JM Precision and the Customer will conduct a final walkthrough or otherwise identify remaining scope items. The Customer should promptly notify JM Precision of concerns so they can be evaluated.

Minor punch-list items do not automatically relieve the Customer from paying undisputed amounts otherwise due. JM Precision will make reasonable efforts to complete valid remaining scope items promptly.

22. LIABILITY / EXISTING CONDITIONS

JM Precision is not responsible for damage or failure attributable to:

Pre-existing structural defects
Concealed deterioration
Hidden damage
Inaccurate Customer information
Undisclosed hazards
Unmarked private underground facilities
Conditions that could not reasonably have been discovered before work began

This limitation does not apply to the extent damage or failure is caused by JM Precision's negligence or as otherwise required by law. Nothing in these Terms waives responsibility or Customer rights that cannot legally be waived.

23. PROJECT PHOTOS / MEDIA

JM Precision may take project photos or videos for estimating, project documentation, quality control, warranty records, internal records, training, and project management.

Unless the Customer requests otherwise in writing, JM Precision may also use before-and-after or project photographs for the website, social media, advertising, and portfolio or marketing purposes, subject to applicable law and JM Precision's Privacy Policy.

JM Precision will not intentionally publish personal Customer information and will honor written Customer requests not to use project media publicly. Customers may contact JM Precision using the information in Section 33 to request that their project photos not be used for marketing purposes.

24. ELECTRONIC COMMUNICATIONS / QUOTEIQ

Normal project communications may occur through QuoteIQ, phone, SMS or text, email, or other reasonable electronic methods.

Electronic approvals, signatures, estimate acceptances, change-order approvals, and related records may be treated as written records to the extent permitted by law.

Marketing communications remain subject to applicable consent requirements and JM Precision's Privacy Policy.

25. CUSTOMER AUTHORITY

The person authorizing work represents that they are the property owner or otherwise have authority to authorize the work. Tenants, property managers, agents, and business representatives are responsible for obtaining any required owner authorization before work begins.

26. SUBCONTRACTORS / SUPPLIERS

JM Precision may use qualified employees, subcontractors, suppliers, delivery companies, equipment providers, or other vendors as reasonably necessary. Scheduling may depend on the availability of these third parties.

JM Precision remains responsible for managing its contracted scope subject to the project agreement.

27. DISPUTES / OPPORTUNITY TO CORRECT

If a dispute or workmanship concern arises, both parties agree to make a reasonable good-faith effort to resolve the issue before pursuing formal legal remedies when circumstances permit.

The Customer should provide reasonable notice of workmanship concerns and give JM Precision a reasonable opportunity to inspect and, where appropriate, correct covered workmanship. Nothing in this section eliminates any right or remedy that cannot legally be waived.

28. GOVERNING LAW

These Terms and the parties' agreement will be governed by the laws of the State of Tennessee, except where another law is required to apply.

29. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

30. NO WAIVER

A party's failure to enforce a provision of the agreement on one occasion does not waive the right to enforce that provision later.

31. ENTIRE AGREEMENT

The agreement consists of the approved QuoteIQ estimate, proposal, or work order; the project-specific scope; these Terms; approved change orders; payment schedules; and other documents expressly incorporated into the project.

Statements not contained in the agreement are not binding unless later confirmed in writing by an authorized JM Precision representative.

32. WEBSITE TERMS VS PROJECT TERMS

The website version of these Terms provides JM Precision's general service terms. A particular QuoteIQ estimate, proposal, contract, change order, payment schedule, warranty document, or other project-specific document may contain additional or more specific provisions.

When a valid project-specific provision conflicts with these general Terms, the more specific project provision controls for that project, subject to applicable law.
